Before making your reservation, it is important that you carefully read the Terms and Conditions and the Hosting Rules and fill out the acceptance form to continue.

TERMS AND CONDITIONS

Each of the properties of The Local Way S.A. of C.V. is a premium property, professionally managed by our company. At the time of your reservation, confirmation, and/or check-in, you accept the policies, terms and conditions, and rules of The Local Way®. Likewise, you previously accept the terms and conditions of use of the platform through which you made your reservation: Airbnb, Booking, VRBO, HomeAway, Kayak, Despegar, or any other means by which the reservation was made.

Upon arrival, you will be required to fill out and sign a registration form and rental agreement (in Spanish or English) in accordance with Mexican law, in addition to the terms and conditions of The Local Way S.A. of C.V. in conjunction with the rental platform through which you made your reservation. This includes reservation holder registration, secondary guest registration, personal information, official ID photo review, signature review, and a security deposit to ensure any potential damage not covered by the platform deposit. of third parties. By completing the reservation on the platform you booked on, you are agreeing to the aforementioned terms. If the guest does not agree to comply with the terms and provide the information requested by the host, the host reserves the right of admission and will proceed to cancel the reservation at any time without any refund.

ALL RIGHTS RESERVED

The Local Way S.A de C.V. reserves the right of admission to any person who does not meet the specifications mentioned here. It is mandatory to show an official identification of the person who generated the reservation and all the people who accompany him.

  • Entry will not be allowed to anyone who is not registered as a guest or visitor.
  • Anyone who does not show official identification will not be allowed to enter.
  • Entry will not be allowed to any minor who is not accompanied by their legal guardian.
  • Any person who does not follow the hygiene rules of the establishment will not be allowed to enter.
  • Reservations to third parties are strictly prohibited. The owner of the reservation must complete the check-in process, as well as stay at the property for the reservation to be valid.
  • Any vehicle that enters the property must be registered with the brand, model, and license plate.
  • The reservation must be paid in full to be valid and confirmed. In the event that the reservation is not paid by the owner, it must be verified with the official identification of the person paying and a letter of agreement.
  • A credit card deposit will be required for all reservations.
  • It is mandatory to sign the “Rental Agreement” at check-in.
 
FEDERAL LAW ON PROTECTION OF PERSONAL DATA POSSESSION OF INDIVIDUALS

Our guests are protected to provide their information as we act under the “Ley Federal para la Protección de Datos Personales”” of Mexico. The information provided will be used only for security reasons and security deposits. No charges will be applied without confirmation of any service and/or verification of any infraction of the house rules. CANCELLATION POLICY

The cancellation policies described below are applicable in accordance with the direct booking policies through The Local Way®.

  • The cancellation is Strict, for the confirmation of the reservation, the payment of the total amount of the reservation must be made, which will not be refundable.
  • For cases of force majeure due to the pandemic, such as border closures or contagion of a member of the trip, a credit will be granted for change of dates with a limit of one year, which will depend on availability and changes in rates.

Once the guest has entered, there are no refunds under any circumstances due to nonconformity of the department, such as climatic situations, accommodation of the department, configuration, amenities, external noise, subjective opinions, among others. The Local Way S.A. of C.V. will not reimburse based on threats of posting negative reviews and will report or denounce the case immediately to the platform and/or corresponding authorities.

 
SPECIFICATIONS
  • Applicable Taxes: 19.5% on the net rate. (16% VAT + 3.5% ISH).
  • Hours: Check-in time is from 4:00 p.m. and the check-out time is before 11:00 am.
  • The keys will be automatically deactivated by the system once the guest’s reservation is complete and they will not be able to access the property.
  • For long-stay reservations, the key will be deactivated in case a renewal payment has not been registered without exception.
  • Concierge: The concierge area is available from 7:00 a.m. to 11:00 p.m. by phone or via chat and will coordinate the service of your request. The operational area is available 24/7 for emergencies.
 
EXTENSION OF STAY WITHOUT THE CONSENT OF THE HOST

In accordance with the terms and conditions of The Local Way S.A. of C.V. specifically in the section “Extension of stay without the consent of the host”, the client accepts that from the moment he/she postpones his/her departure from the date and time stipulated in the current registration, without the authorization of the host, his/her access card will be deactivated automatically, as well as the corresponding charge to the credit card, with double the agreed rate for the stay of a single night during each day that passes until the property is vacated, and the host will have the right to take legal action to evict you from the property, and the costs of such legal action will also be charged to the guest’s card. By confirming the reservation, and/or signing our “Rental Agreement” at the time of your arrival, you agree to all our Terms and Conditions, Rules, and Policies.

 
FORTUITOUS CASES OR FORCE MAJEURE

The Local Way S.A. de C.V. disclaims any damage caused to the health of the guest or their belongings due to theft, loss, or force majeure. As well as for damages caused directly by the client and/or his guests. Being understood as force majeure the event of rupture, illness, pandemic, failures, short circuits, leaks, collapses, fires, natural disasters, or accidents, since the client assumes them at their own risk, releasing the host and The Local Way S.A. de C.V. from any responsibility in any of these cases.

 
PROHIBITION OF TRANSFERRING ACCOMMODATION RIGHTS

The current accommodation is for the client and his companions exclusively. Any sublease and/or transfer in whole or in part, temporarily or permanently, free or for a fee is prohibited. In case of not respecting this provision, the client will respond with a penalty of $10,000 MXN (ten thousand Mexican pesos) for each day that this situation elapses.

 
LEGAL COMPETENCE

In the event of a lawsuit, those involved are subject to the legal jurisdiction of the Ordinary Courts in Mexico City and the current laws of the country, waiving other laws that may be applicable.

We reserve the right of admission to any person who does not meet the access requirements: payment, guarantee card, official identification, registration with full name (matching the ID) of all persons entering the property and signature on the “Rental Agreement” and any information or term mentioned above

FINANCIAL PENALTIES FOR DAMAGE TO FACILITIES

You as a guest declare that you are aware of the section entitled “Damage to the facilities” contained in the Terms and Conditions of The Local Way S.A. de C.V., Airbnb, Expedia, Booking, HomeAway, VRBO, or any other platform through which the reservation was made, expressing prior knowledge of such conditions. Therefore, it expresses agreement that The Local Way S.A. de CV, Airbnb, Expedia, Booking, HomeAway, VRBO, or any other platform through which the reservation was made will charge your card in the event that the property where you are staying suffers any kind of damage caused by the guest, or a person staying at the property or any other person who has been authorized access to the property, after receiving evidence proving said damages.

The host reserves the right to inspect the property where the guest is staying, personally or through designated third parties, during business hours and for the entirety of the agreed stay.

HOUSING RULES
SPECIFIC RULES OF THE STAY:
  1. Reservations to third parties are strictly prohibited.
  2. All guests must present official identification for access.
  3. Access to the property is restricted to UNregistered guests.
  4. Only a limited number of people will be able to enter each department.
  5. In the event that the host and building grants entry authorization to a greater number of people (IN WRITING), the guest will provide a list of visitors, which must not exceed six people, who must present official identification. Under no circumstances may visitors remain on the premises after 12 a.m. ***The host reserves the right to apply additional charges for this situation.
  6. It is strictly forbidden to organize parties or events within the property, failure to comply with this rule may result in the cancellation of the reservation and complaint to the local authorities.
  7. Running, jumping, and making noise on stairs, hallways, elevators, and common areas are prohibited. As well as generating disturbances to other guests.
  8. The use of loudspeakers and music should be at a moderate volume, so that it does not disturb the rest of the residents, especially at night.
  9. Making loud noises at night is prohibited.
  10. It is forbidden to move furniture, decorate, paint or move any object part of the decoration from its original place, without the express consent of the host.
  11. Any damage to the property or items therein is the responsibility of the guest and must be paid for, replaced, or repaired by the guest.
  12. It is forbidden to make any type of modification or improvement to the property.
  13. Smoking is prohibited in any part of the apartment, including open areas such as balconies or windows, nor is smoking allowed in any area of ​​the building. We are a smoke-free business.
  14. Charges for the use of “other services”, such as laundry, ironing, and transportation must be quoted by the concierge area and paid before the departure of each service.
  15. The access door to the property closes automatically, it cannot be opened without a key and/or access code. Have the key and/or access code at all times. The opening of doors will be subject to the availability of the staff and may carry an extra cost.
  16. It is forbidden to introduce flammable, explosive, and dangerous substances or objects into the property, as well as objects or substances that cause an unpleasant odor.
  17. It is prohibited to store or use any type of illegal substance on the property. The possession, use, and/or manufacture of drugs, narcotics, or any illegal substance is strictly prohibited and failure to comply with this rule will be regulated by local authorities.
  18. It is strictly prohibited to carry out any illicit activity within the property.
  19. The host is not responsible for the loss of valuables, jewelry, as well as documents of the guest or guests. The Local Way S.A de C.V. puts at the service of the guest a safety box in each department, which will be provided upon request.
  20. Make sure to close the main door of the property every time you leave the apartment. At the end of your stay, you must leave the keys on the kitchen counter.
  21. Lost and found items are delivered to the guest’s address by prior request only. Shipping costs will be borne by the guest.
  22. The departure time is forced before 11:00 a.m. unless you have written authorization from the host to leave at a different time.
  23. Any damage or malfunction in the room must be reported immediately to the concierge. Any guest who, intentionally or accidentally, damages or loses any object or article in the apartment, will be responsible for the cost of the damaged object and/or the cost of partial or total repair.
  24. Before leaving the property, make sure you turn off all water taps and faucets, turn off lights, turn off stoves, fans, televisions, or any electrical appliances.
  25. Walking and staying in common areas of the building wearing inappropriate clothing such as pajamas, underwear, and bathing suits are strictly prohibited. Walking naked is prohibited at all times.
  26. No pets allowed.
  27. Pillows, sheets, towels, and other linens must be used during your stay and must not be removed at any time.
  28. Locate the emergency exits immediately upon arrival at the property.
 
PENALTIES FOR BREAKING THE STIPULATED RULES

The client authorizes charges for each violation of the current rules since the guest enters the property and The Local Way S.A. of C.V. will be notified of any violation incurred by the client or another guest or person accompanying him. For these actions, the host will proceed in accordance with the payment policies of The Local Way S.A. de CV, Airbnb, Expedia, Booking, HomeAway, VRBO, or any other platform through which the reservation was made, discounting the amount corresponding to the security deposit given by the client, in accordance with what is specified in the “Deposit security” of Airbnb, Expedia, Booking, HomeAway, VRBO, or any other platform through which the reservation was made. These sanctions will apply without prejudice to the civil or criminal liabilities that the client or the rest of his guests may incur.

ADDITIONAL FINES

  • $10 USD (ten US dollars) per key lost, misplaced, or not returned.
  • $35 USD (thirty-five American dollars) for extra cleaning service from Monday to Saturday.
  • $45 USD (forty-five American dollars) for extra cleaning service on Sunday.
  • $300 USD (three hundred American dollars) fine for smoking in any area of ​​the apartment and/or building.
  • $1,000 USD (one thousand US dollars) fine for breaking any stipulated rule in this contract.
  • $300 USD (three hundred US dollars) for misuse of resources such as water, gas, and/or electricity.

 

By signing completing the reservation, and/or signing our “Rental Agreement”, you accept all charges to your credit card in case of incurring any of the fines mentioned above.
